Fines issued to motorists caught parking on recently installed double yellow lines on Carrick-on-Suir's John Street are invalid because there is no bye-law in place sanctioning them, a council meeting heard.

Carrick-on-Suir Cllr Kieran Bourke has called on the council to remove the formerly “temporary” double yellow lines on John Street, Carrick or introduce a bye-law legally sanctioning them.

He issued the call at Carrick-on-Suir Municipal District’s January meeting after asking council engineer Kieran Malone if a bye-law was required in order to make double yellow lines installed in a place they hadn’t been before legal and proper.

Mr Malone confirmed to him that generally a bye-law needs to be introduced in order to put in place double yellow lines at a specified location.

The Fianna Fáil councillor had appealed at Carrick Municipal District’s October meeting for the double yellow lines painted on Mill Street and John Street to be removed as residents were assured they were temporary.

They were put in place to accommodate HGVs diverted down these streets while work was taking place on N24 Carrick-on-Suir Pavement & Road Safety Scheme, which is now finished

Cllr Bourke told the latest meeting of district councillors that while District Engineer Michael Scully removed the double yellow lines on Mill Street he decided to leave the lines in place on John Street as he felt they were warranted.

He thanked Mr Malone for clarifying the position in relation to bye-laws and pointed out that any parking ticket issued to motorists parking on the double yellow lines on John Street was currently not valid.

“They are breaking no law as there is no bye-law in place. We either remove them or put a bye-law in place but we can't leave it like it is,” he declared.
