Dundrum Heritage Group have released a statement following the news that Tipperary County Council will not contest the Judicial Review brought by the Dundrum Heritage Group to quash the Section 5 declaration issued in respect of Dundrum House.
In a statement issued to media on Tuesday afternoon following the announcement, Dundrum Heritage Group have written:
"Dundrum Heritage was granted leave to pursue a Judicial Review to quash the Section 5 declaration issued by the Council to Brogan Capital Ventures Ltd concerning Dundrum House. The parties to the review included Tipperary County Council, Brogan Capital Ventures Ltd., Ireland and the Attorney General.

"On 23 April 2025, Tipperary County Council issued a warning letter to Brogan Capital Ventures Ltd, citing a number of unauthorised developments at Dundrum House, including a wastewater treatment system and ancillary structures.
"In a revised affidavit submitted in May 2025, Dundrum Heritage asserted that the site was not planning compliant at the time the Section 5 was issued, and therefore the declaration was invalid. Tipperary County Council has now opted not to contest the case.
"The court had originally scheduled a hearing for 29 September 2025. However, our solicitor, Ronan Kennedy of Kennedy Frewen O’Brien Solicitors, will now seek an earlier date with a view to having the Section 5 declaration quashed.
"It is important to note that this outcome is not automatic and remains at the discretion of the court—it may still be challenged by the other parties to the judicial review.

"We wish to reaffirm that Dundrum Heritage and its supporters are not opposed to the provision of IPAS accommodation. However, we maintain that Dundrum House is an unsuitable location for such a facility.
"Our objectives remain as follows:
1.To preserve and restore Dundrum House, a 300-year-old nationally significant heritage property and protected structure.
2.To reactivate the hotel and leisure complex as a fully functioning facility offering accommodation, dining, functions, leisure, and golf amenities. 3.To revitalise the local economy by promoting tourism and employment through the return of Dundrum House to its original intended use.
"We wish to thank all our supporters and acknowledge the assistance received from our local representatives—especially Michael Murphy TD and Councillors Mary Hanna Hourigan and Liam Browne—as well as our legal team led by Ronan Kennedy."
