BREAKING: Man charged in Tipperary fatal assault case remanded in custody for a third time

The man charged in connection to the death of Maciej Nowak, who was found dead after a house party in Kilross on Stephen’s Day, has been remanded in custody for a third time.

Tomasz Rozpeda, 27, of no fixed abode, appeared before Judge Elizabeth MacGrath at a sitting of Tipperary Town District Court in Nenagh.

The defendant is charged with assault causing harm contrary to Section three of the Non-fatal Acts Against the Person Act 1997.

Mr Rozpeda was assisted in court by a Polish interpreter.

Sgt Cathal Godfrey of Tipperary Town Garda Station made an application for Mr Rozpeda to be remanded in custody further as they were still awaiting DPP instructions.

Judge MacGrath noted that the defendant had been remanded in custody twice already.

The judge said she had heard the application in December, and her colleague had heard a second one in early January.

Judge MacGrath asked the solicitor acting for the defendant, Vincent McCormack, if he was making a bail application on behalf of his client.

Mr McCormack told the court that there had been ‘some difficulty with accommodation’ and they were not in a position to apply for bail at this time.

Judge MacGrath put the matter back to February 7 for the defendant to appear by video link with the assistance of an interpreter.

Mr McCormack pointed out that there had been some difficulty with getting an interpreter in court that morning.

The case had been called earlier in the day and was left to stand while the court retained an interpreter.

During the morning sitting, Mr McCormack pointed out that there had been two interpreters at the last sitting, and there was none at this one.

Mr Rozpeda was asked if he would like to address the court, and he declined.

Maciej Nowak, 32, was found dead at a house in Ballycrana, Kilross, on Wednesday, December 27, following what is believed to be an assault.
