A Tipperary motorist who was caught speeding in Limerick was convicted and fined despite his assertion that he did not receive the fixed charged penalty notice in the post.
At Newcastle West Court, Garda Ivan Lucid said Richard O’Gorman - who has an address in Curraheen, Shallee, Nenagh, county Tipperary - was detected driving at 100km/h in a 60km/h zone on the N21 at Gortboy, Newcastle West on March 26, 2025.
Giving evidence under oath, Mr O’Gorman claimed that he did not receive the fixed penalty notice in the post and that the only documentation he received was the court summons.
"I never received the fine, I would have paid it if I got it," he said.
Prosecuting Garda Inspector Barry Manton then asked Mr. O’Gorman if he usually has problems with his post, to which the defendant replied: “I haven’t had problems with my address.” He also confirmed he has been living at his current address since 2008.

Insp. Manton then put it to Mr O’Gorman that he had appeared in court on several occasions in the past having experienced difficulties with his post - particularly relating to fines.
"Over 15 times, this has happened to you," he suggested to the witness reminding him that he was "under oath."
In reply, Mr O’Gorman agreed that he has found himself in a similar situation “maybe two to four” times in the past.
The prosecuting inspector said he found Mr O’Gorman’s answers to be “evasive”, and again reminded Mr O'Gorman that he was under oath.
Having considered the matter, Judge Carol Anne Coolican convicted and fined Mr O’Gorman €600.
While not a matter for the court, the defendant will also received penalty points on his licence.
